Last updated: July 8, 2026
This Privacy Policy ("Policy") describes how UrbFact ("we," "us," "our," or the "Company") collects, uses, discloses, retains, and protects information when you access, browse, or otherwise use the website located at urbfact.com, including all subdomains, pages, features, content, applications, and services offered through the website (collectively, the "Site"). This Policy applies to all visitors, users, registered members, and any other persons who access or use the Site in any capacity (collectively, "you" or "users"). By accessing or using the Site in any manner, including but not limited to visiting, browsing, registering an account, submitting a contact form, subscribing to newsletters, or clicking on advertisements, you acknowledge that you have read, understood, and agree to be bound by this Privacy Policy in its entirety. If you do not agree to this Policy, you must immediately discontinue all use of the Site. We reserve the right to modify this Policy at any time, and your continued use of the Site following any such modifications constitutes your acceptance of the revised Policy.
1. Scope and Applicability
This Privacy Policy governs the collection and use of information through the Site and applies to all data gathered through the Site, email communications, text messages, and other electronic messages between you and the Site. This Policy does not apply to information collected by any third party, including through any application or content (including advertising) that may link to or be accessible from the Site. We encourage you to read the privacy policy of every website you visit. This Policy is incorporated into and made a part of our Terms of Service. Capitalized terms not defined herein shall have the meanings ascribed to them in the Terms of Service. The Site is operated from the United States of America and is intended for users located worldwide. If you are accessing the Site from outside the United States, please be advised that your information will be transferred to, stored in, and processed in the United States, where privacy laws may not be as protective as those in your jurisdiction. By using the Site, you expressly consent to the transfer of your information to the United States and the processing of your information in accordance with this Policy.
2. Information We Collect
We collect several categories of information from and about users of our Site, including information by which you may be personally identified, such as your name, email address, and any other identifier by which you may be contacted online or offline ("personal information"); information that is about you but individually does not identify you, such as your browsing history on the Site, search queries, city pages viewed, and comparison tools used; and information about your internet connection, the equipment you use to access our Site, and usage details, including your IP address, browser type, browser version, operating system, device type, screen resolution, language preferences, referring and exit pages, date and time stamps, clickstream data, and other technical information that your browser or device automatically transmits to our servers.
When you create an account on the Site, we collect the information you provide during the registration process, including your full name, email address, and password. Your password is stored exclusively as a one-way cryptographic hash using the bcrypt algorithm with an appropriate cost factor. We never store, log, or have access to your plaintext password. When you use our contact form, we collect your name, email address, and the content of your message for the sole purpose of responding to your inquiry. When you subscribe to our newsletter, we collect your email address to deliver periodic updates regarding new data, features, and site improvements. You may unsubscribe from our newsletter at any time by clicking the unsubscribe link included in every email or by contacting us directly.
We want to be transparent about what we do not collect. We do not collect, process, or store Social Security numbers, driver's license numbers, passport numbers, financial account numbers, credit or debit card numbers, health or medical information, biometric data, racial or ethnic origin data, political opinions, religious or philosophical beliefs, trade union membership information, genetic data, or any other categories of sensitive personal information as defined under applicable privacy laws. The city, county, state, metro area, and country data displayed throughout the Site is derived entirely from publicly available government datasets and open data sources, does not contain personal information about any identifiable individual, and is presented solely for informational, educational, and research purposes.
3. Automatic Data Collection Technologies
As you navigate through and interact with our Site, we use automatic data collection technologies to gather certain information about your equipment, browsing actions, and patterns. The technologies we use for this automatic data collection include cookies (small files placed on the hard drive of your device), web beacons (small electronic files also known as clear gifs, pixel tags, and single-pixel gifs), and server log files that record information about your visit including your IP address, the date and time of your request, the page you requested, the referring page, your user agent string, and the status code returned by the server. This information helps us improve our Site and deliver a better and more personalized service by enabling us to estimate our audience size and usage patterns, store information about your preferences, allowing us to customize our Site according to your individual interests, speed up your searches, and recognize you when you return to our Site.
We use the following specific categories of cookies on our Site. Essential cookies are strictly necessary for the Site to function properly and cannot be disabled without materially affecting the functionality of the Site. These cookies manage user sessions, maintain authentication state for logged-in users, store CSRF (Cross-Site Request Forgery) protection tokens to secure form submissions, and remember essential user preferences such as selected country or region filters. Analytics cookies, specifically those set by Google Analytics (including the _ga, _gid, and _gat cookies), are used to collect anonymous, aggregated information about how visitors interact with the Site, including which pages are visited most frequently, how long users spend on each page, what search queries are entered, which geographic regions generate the most traffic, and how users navigate between pages. Google Analytics uses IP anonymization, which means the last octet of your IP address is masked before storage or processing. For comprehensive information about how Google Analytics collects and processes data, please visit Google's Privacy Policy. You may opt out of Google Analytics tracking entirely by installing the Google Analytics Opt-Out Browser Add-on, which is available for all major browsers. Advertising cookies may be set by Google AdSense and its advertising partners to build a profile of your interests and show you relevant advertisements on other websites. These cookies track your browsing activity across multiple websites and may be used to limit the number of times you see an advertisement and to measure the effectiveness of advertising campaigns.
You have the right to decide whether to accept or reject cookies. Most web browsers are set to accept cookies by default. You can usually modify your browser settings to decline cookies or to alert you when cookies are being sent. If you choose to decline cookies, some parts of the Site may not function properly or may become inaccessible. Please note that cookie-based opt-outs are browser and device specific, so you will need to set your preferences for each browser and device you use to access the Site. You may also manage your advertising preferences through the following industry tools: the Network Advertising Initiative (NAI) Opt-Out Tool, the Digital Advertising Alliance (DAA) Opt-Out Tool, and the European Interactive Digital Advertising Alliance (EDAA) Your Online Choices Tool for users located in the European Economic Area.
4. Advertising and Third-Party Ad Networks
We display advertisements on the Site through Google AdSense, a third-party advertising service operated by Google LLC (1600 Amphitheatre Parkway, Mountain View, California 94043, United States). Google AdSense uses cookies, JavaScript, and web beacons to serve advertisements that are relevant to you based on your browsing history, search activity, demographic information, geographic location, and other factors. When you view or click on an advertisement displayed on the Site, Google and its advertising partners may collect information about your interaction with the advertisement, including the advertisement you viewed or clicked, the date and time of the interaction, and your IP address. This information may be combined with information collected from other websites and services to build a profile of your online activity and interests. Google's use of the DoubleClick cookie enables it and its partners to serve ads to you based on your visit to the Site and other sites on the Internet. We do not have access to or control over the cookies, web beacons, or other tracking technologies that may be used by third-party advertisers, and the information practices of these third-party advertisers are not covered by this Privacy Policy. You may opt out of the use of the DoubleClick cookie for interest-based advertising by visiting Google Ad Settings. We are not responsible for the effectiveness of any opt-out mechanisms provided by third parties.
5. How We Use Your Information
We use information that we collect about you or that you provide to us, including any personal information, for the following purposes: to present our Site and its contents to you in an optimized manner; to provide you with information, products, or services that you request from us; to fulfill any other purpose for which you provide it; to carry out our obligations and enforce our rights arising from any contracts entered into between you and us; to notify you about changes to our Site, our policies, or any products or services we offer or provide through it; to allow you to participate in interactive features on our Site, including city comparisons, search functionality, the City Finder tool, the Cost of Living Calculator, and other data exploration tools; to monitor and analyze trends, usage, and activities in connection with our Site to improve the user experience, identify popular content, and develop new features; to detect, investigate, and prevent fraudulent transactions, unauthorized access, and other illegal activities and protect the rights, property, and safety of UrbFact and others; to personalize your experience on the Site by presenting content and features that are tailored to your interests and browsing patterns; to respond to law enforcement requests and as required by applicable law, court order, or governmental regulations; and for any other purpose with your consent. We do not sell, rent, lease, trade, or otherwise make available your personal information to any third party for their direct marketing purposes. We have not sold any personal information in the preceding twelve (12) months and have no plans to do so in the future.
6. Disclosure of Your Information
We may disclose aggregated, anonymized information about our users, and information that does not identify any individual, without restriction. We may disclose personal information that we collect or you provide as described in this Privacy Policy to our subsidiaries and affiliates for purposes consistent with this Policy; to contractors, service providers, and other third parties we use to support our business operations, including but not limited to web hosting providers, email delivery services, analytics providers, and content delivery networks, who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them; to a buyer or other successor in the event of a merger, acquisition, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us about our Site users is among the assets transferred; to fulfill the purpose for which you provide it; for any other purpose disclosed by us when you provide the information; with your consent; to comply with any court order, law, or legal process, including to respond to any government or regulatory request; to enforce or apply our Terms of Service and other agreements; and if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of UrbFact, our users, or others, including exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.
7. Data Sources, Attribution, and Accuracy Disclaimer
All statistical, demographic, geographic, economic, environmental, educational, and infrastructure data displayed on the Site is sourced exclusively from publicly available datasets published by United States federal government agencies, Canadian government agencies, international organizations, and reputable open data providers. ALL DATA, CONTENT, INFORMATION, SCORES, RANKINGS, COMPARISONS, CALCULATIONS, AND OTHER MATERIALS DISPLAYED ON THIS SITE ARE PROVIDED STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, RELIABILITY, TIMELINESS, OR NON-INFRINGEMENT. While we make reasonable efforts to ensure the accuracy and currency of the data presented on this Site, we make no representations, warranties, or guarantees whatsoever as to the accuracy, completeness, currency, correctness, reliability, integrity, quality, fitness for purpose, or originality of any content displayed on the Site. Government datasets are subject to revision, correction, and periodic updates by the issuing agencies, and the data displayed on this Site may not reflect the most recently published figures. City scores, rankings, grades, and composite indices displayed on this Site are calculated algorithmically based on our proprietary methodology applied to the underlying public data. These scores represent our computational interpretation of the data and are not official government ratings, endorsements, or certifications of any kind. Different methodologies, weightings, or data sources may yield different results.
UrbFact is an independent, privately operated website. We are not affiliated with, endorsed by, sponsored by, licensed by, or in any way officially connected with the United States Census Bureau, the Bureau of Labor Statistics, the Federal Bureau of Investigation, the National Oceanic and Atmospheric Administration, the United States Geological Survey, the National Center for Education Statistics, the Centers for Medicare and Medicaid Services, the Federal Communications Commission, the National Interagency Fire Center, Zillow Group Inc., GeoNames, or any other government agency, municipality, county, state, or data provider referenced on this Site. All agency and organization names, logos, and trademarks referenced on this Site are the property of their respective owners and are used solely for purposes of accurate data attribution. YOU SHOULD NOT RELY SOLELY ON THE DATA, SCORES, RANKINGS, OR OTHER INFORMATION PRESENTED ON THIS SITE FOR MAKING FINANCIAL, REAL ESTATE, RELOCATION, INVESTMENT, INSURANCE, EMPLOYMENT, EDUCATIONAL, HEALTHCARE, SAFETY, OR OTHER SIGNIFICANT PERSONAL OR BUSINESS DECISIONS. Always verify information through official government sources, consult qualified professionals (including licensed real estate agents, financial advisors, attorneys, or other relevant experts), and conduct your own independent research before making any decision based on information obtained from this Site.
8. Third-Party Services and Integrations
The Site relies on several third-party services to deliver functionality, security, analytics, and advertising. Each of these services may independently collect, process, and store data about you in accordance with their own privacy policies, over which we have no control. These services include: Google Analytics, a web analytics service provided by Google LLC, which uses cookies and similar technologies to collect and analyze information about the use of the Site and report on website activities (Google Privacy Policy); Google AdSense, an advertising service provided by Google LLC, which serves third-party advertisements on the Site and may use cookies to personalize ads (Google Privacy Policy); Cloudflare Inc., which provides content delivery network (CDN) services, distributed DNS, DDoS protection, and web application firewall services, and may process your IP address, HTTP request headers, and other connection data in the course of routing your traffic to our servers (Cloudflare Privacy Policy); and Cloudflare Turnstile, a CAPTCHA alternative service provided by Cloudflare Inc., which is used on certain forms on the Site to distinguish human users from automated bots without requiring users to solve visual puzzles. We strongly encourage you to review the privacy policies of each of these third-party services, as their data practices are governed by their own policies and not by this Privacy Policy. We are not responsible for the privacy practices, data collection methods, or security measures employed by any third-party service provider.
9. Third-Party Links and External Websites
The Site may contain hyperlinks to third-party websites, including but not limited to government agency websites, data source portals, news articles, reference materials, and other external resources. These hyperlinks are provided solely for your convenience and informational purposes and do not constitute an endorsement, sponsorship, recommendation, or approval by UrbFact of the content, products, services, or privacy practices of the linked websites. We have no control over the nature, content, privacy policies, terms of service, data collection practices, or availability of third-party websites. When you click on a link to a third-party website, you leave our Site, and your interactions with the third-party website are governed exclusively by that website's own terms and policies. We are not responsible or liable for any damages, losses, or harm arising from your use of, access to, or reliance on any content, goods, services, or information available on or through any third-party website. We recommend that you exercise caution and review the privacy policy and terms of service of every third-party website you visit before providing any personal information or engaging in any transaction.
10. Data Retention
We retain your personal information only for as long as is reasonably necessary to fulfill the purposes for which it was collected, as described in this Policy, unless a longer retention period is required or permitted by law. Specifically, account registration data (name, email, hashed password) is retained for the duration of your account's existence and will be deleted within thirty (30) days of your request to delete your account or upon account termination, except where retention is necessary for legitimate business purposes such as fraud prevention, dispute resolution, or compliance with legal obligations. Contact form submissions, including your name, email, and message content, are retained for up to twelve (12) months from the date of submission and are then permanently deleted from our systems. Server access logs, including IP addresses, request URLs, user agent strings, and timestamps, are retained for up to ninety (90) days for security monitoring, abuse prevention, and diagnostic purposes, and are then automatically purged. Newsletter subscription data (email address and subscription preferences) is retained until you unsubscribe or request removal. Google Analytics data is subject to Google's own data retention policies and is currently configured with a retention period of fourteen (14) months, after which individual user-level and event-level data is automatically deleted from Google's servers. Upon expiration of the applicable retention period, personal information is either permanently deleted, anonymized, or de-identified such that it can no longer be associated with you.
11. Data Security
We have implemented and maintain reasonable administrative, technical, organizational, and physical security measures designed to protect the confidentiality, integrity, and availability of your personal information against unauthorized access, alteration, disclosure, destruction, loss, or misuse. These measures include, but are not limited to: encryption of all data in transit using HTTPS with TLS 1.2 or higher; storage of user passwords exclusively as bcrypt cryptographic hashes with appropriate computational cost factors, ensuring that plaintext passwords are never stored, logged, or transmitted; implementation of Cross-Site Request Forgery (CSRF) protection tokens on all forms and state-changing requests; rate limiting on authentication endpoints to prevent brute-force attacks, with automatic lockout after five (5) consecutive failed login attempts for a period of fifteen (15) minutes; enforcement of secure, HTTP-only, SameSite cookie attributes for session management; use of Cloudflare's web application firewall (WAF) and DDoS protection services; regular application of security patches and software updates to the server operating system, web server, PHP runtime, and database software; use of parameterized database queries throughout the application to prevent SQL injection attacks; validation and sanitization of all user input to prevent cross-site scripting (XSS) and other injection attacks; and periodic review of security practices and access controls. Notwithstanding the foregoing, no method of transmission over the Internet, no method of electronic storage, and no security system is impenetrable or can be guaranteed to be 100% secure. While we strive to use commercially reasonable means to protect your personal information, we cannot and do not guarantee the absolute security of your information. Any transmission of personal information is at your own risk, and we are not responsible for the circumvention of any privacy settings or security measures contained on the Site. In the event of a data breach that compromises your personal information, we will notify affected users and relevant authorities in accordance with applicable law.
12. Your Privacy Rights
Depending on your location and applicable law, you may have certain rights with respect to the personal information we hold about you. We are committed to facilitating the exercise of these rights in a timely manner. All users, regardless of location, have the right to access the personal information we hold about them, to request correction or update of inaccurate or incomplete personal information, to request deletion or erasure of their personal information (subject to certain legal exceptions), to opt out of receiving marketing communications at any time by clicking the unsubscribe link in any email or contacting us directly, and to disable or manage cookies through their browser settings as described in Section 3 of this Policy. To exercise any of these rights, please contact us at [email protected] with a description of your request. We will respond to all legitimate requests within thirty (30) days. In certain circumstances, we may need to verify your identity before processing your request, and we may request additional information from you to do so.
If you are a resident of the State of California, United States, you may have additional rights under the California Consumer Privacy Act of 2018 (CCPA), as amended by the California Privacy Rights Act of 2020 (CPRA). Under the CCPA/CPRA, California residents have the right to know what categories and specific pieces of personal information we have collected about them, the categories of sources from which the personal information was collected, the business or commercial purpose for collecting the personal information, and the categories of third parties with whom we share personal information. California residents also have the right to request that we delete any personal information we have collected from them, subject to certain exceptions provided by law, including where retention is necessary to complete a transaction, detect security incidents, comply with legal obligations, or engage in certain research activities. California residents have the right to opt out of the sale or sharing of their personal information. We want to be clear: we do not sell and have never sold personal information to third parties as defined under the CCPA/CPRA. If our practices change in the future, we will update this Policy and provide a conspicuous "Do Not Sell or Share My Personal Information" link on the Site. California residents have the right not to receive discriminatory treatment for exercising any of their CCPA/CPRA rights. We will not deny you goods or services, charge you different prices, provide you a different level or quality of goods or services, or suggest that you will receive a different price or different level or quality of goods or services because you exercised your privacy rights. To submit a verifiable consumer request under the CCPA/CPRA, please contact us at [email protected]. We will acknowledge receipt of your request within ten (10) business days and provide a substantive response within forty-five (45) calendar days, as required by law. If we need additional time, we will inform you of the reason and extension period in writing, not to exceed an additional forty-five (45) days.
If you are located in the European Economic Area (EEA), the United Kingdom, or Switzerland, you may have certain rights under the General Data Protection Regulation (GDPR), the UK GDPR, and the Swiss Federal Act on Data Protection (FADP), as applicable. These rights include the right of access to your personal data, the right to rectification of inaccurate personal data, the right to erasure of your personal data (the "right to be forgotten"), the right to restriction of processing of your personal data, the right to data portability (receiving your personal data in a structured, commonly used, and machine-readable format), the right to object to processing of your personal data based on legitimate interests or for direct marketing purposes, the right not to be subject to automated decision-making including profiling, and the right to withdraw consent at any time where processing is based on consent, without affecting the lawfulness of processing based on consent before its withdrawal. Our lawful bases for processing personal data under the GDPR are: (a) your consent, which you provide when you voluntarily submit information through contact forms, registration forms, or newsletter subscriptions; (b) our legitimate interests in operating, maintaining, and improving the Site, analyzing usage patterns, preventing fraud, and ensuring security, provided that such interests are not overridden by your fundamental rights and freedoms; and (c) compliance with legal obligations to which we are subject. To exercise any of your rights under the GDPR or applicable European data protection laws, please contact us at [email protected]. If you believe that our processing of your personal data infringes applicable data protection law, you have the right to lodge a complaint with a supervisory authority in the EU Member State of your habitual residence, your place of work, or the place of the alleged infringement.
13. Children's Privacy
The Site is intended for a general audience and is not directed to, marketed to, or intended for use by children under the age of thirteen (13), or under the age of sixteen (16) for residents of the European Economic Area. We do not knowingly collect, solicit, or maintain personal information from anyone under the age of thirteen (13), and we do not knowingly allow such persons to register for an account or use any interactive features of the Site. In the event that we learn that we have collected personal information from a child under the age of thirteen (13) without verification of parental consent, we will take immediate steps to delete that information from our servers. If you are a parent or guardian and you believe that your child under the age of thirteen (13) has provided personal information to us, please contact us immediately at [email protected] so that we can take appropriate action to remove such information. If you are under the age of thirteen (13), please do not use or access the Site in any manner, do not provide any information on the Site or through any of its features, and do not register for an account, use any interactive features, subscribe to our newsletter, or provide your name, address, telephone number, email address, or any other personal information to us.
14. Do Not Track Signals
Certain web browsers may transmit "Do Not Track" (DNT) signals to websites and online services with which the browser communicates. There is currently no universally accepted standard for how companies should respond to DNT signals, and the World Wide Web Consortium (W3C) has discontinued its efforts to develop a DNT standard. Accordingly, the Site does not currently recognize or respond to DNT signals or similar mechanisms. However, as described elsewhere in this Policy, you have choices regarding the collection and use of your information, including the ability to opt out of Google Analytics tracking, manage advertising preferences through industry opt-out tools, control cookie settings through your browser, and exercise your rights under applicable privacy laws.
15. International Data Transfers
The Site is owned and operated from the United States of America. Our servers are located in North America. If you are accessing the Site from the European Economic Area, the United Kingdom, Switzerland, Canada, or any other jurisdiction with data protection laws that differ from those of the United States, please be aware that any personal information you provide to us or that is automatically collected will be transferred to, stored in, and processed in the United States and potentially other countries where our service providers maintain facilities. The data protection and privacy laws of the United States and these other countries may not be as comprehensive as or equivalent to those in your country of residence. By using the Site, submitting information through the Site, or otherwise providing personal information to us, you explicitly and unambiguously consent to the transfer of your personal information to the United States and to the processing of your personal information in the United States in accordance with this Privacy Policy. Where required by applicable law, we will ensure that appropriate safeguards are in place to protect your personal information during international transfers, which may include standard contractual clauses approved by the European Commission or other lawful transfer mechanisms.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL URBFACT, ITS OWNERS, OPERATORS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, SUPPLIERS, AFFILIATES, SUCCESSORS, OR ASSIGNS (COLLECTIVELY, THE "RELEASED PARTIES") BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF THE RELEASED PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), ARISING OUT OF OR IN CONNECTION WITH: (A) YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE SITE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SITE, INCLUDING WITHOUT LIMITATION ANY DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES; (C) ANY CONTENT, DATA, INFORMATION, SCORES, RANKINGS, CALCULATIONS, OR MATERIALS OBTAINED FROM THE SITE, INCLUDING ANY ERRORS, INACCURACIES, OMISSIONS, OR OUTDATED INFORMATION CONTAINED THEREIN; (D) ANY UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF YOUR TRANSMISSIONS OR DATA STORED ON OUR SERVERS; (E) ANY DECISION MADE, ACTION TAKEN, OR FAILURE TO ACT IN RELIANCE ON ANY DATA, INFORMATION, SCORE, RANKING, OR OTHER CONTENT OBTAINED FROM OR THROUGH THE SITE; (F) ANY INTERRUPTION, SUSPENSION, OR TERMINATION OF THE SITE OR ANY SERVICES OFFERED THROUGH THE SITE; OR (G) ANY VIRUSES, TROJAN HORSES, WORMS, OR OTHER MALICIOUS CODE THAT MAY BE TRANSMITTED TO OR THROUGH THE SITE BY ANY THIRD PARTY. IN NO EVENT SHALL THE AGGREGATE LIABILITY OF THE RELEASED PARTIES TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE SITE EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US $100.00) OR THE AMOUNT YOU HAVE PAID TO URBFACT IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. THE LIMITATIONS OF LIABILITY SET FORTH IN THIS SECTION SHALL APPLY REGARDLESS OF THE FORM OF ACTION, WHETHER THE CLAIM IS BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, STATUTE, OR ANY OTHER LEGAL OR EQUITABLE THEORY, AND REGARDLESS OF WHETHER THE DAMAGES WERE FORESEEABLE.
17. Indemnification
You agree to indemnify, defend, and hold harmless UrbFact, its owners, operators, officers, directors, employees, agents, licensors, suppliers, affiliates, successors, and assigns from and against any and all claims, actions, suits, proceedings, liabilities, obligations, damages, losses, costs, debts, and expenses (including but not limited to reasonable attorneys' fees, court costs, expert witness fees, and costs of investigation) arising out of or relating to: (a) your access to or use of the Site; (b) your violation of any term or provision of this Privacy Policy or our Terms of Service; (c) your violation of any applicable federal, state, local, or international law, rule, or regulation; (d) your violation of any rights of any third party, including but not limited to intellectual property rights, privacy rights, and publicity rights; (e) any content, data, or materials you submit, post, or transmit through the Site; or (f) any claim that your use of the Site caused damage to a third party. This indemnification obligation shall survive the termination of your account, your cessation of use of the Site, and the termination of this Privacy Policy.
18. Dispute Resolution and Governing Law
This Privacy Policy and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the United States of America, without giving effect to any choice of law or conflict of law provisions or rules (whether of the United States or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the United States. Any legal suit, action, or proceeding arising out of or relating to this Privacy Policy or the Site shall be instituted exclusively in the federal courts of the United States or the courts of the state in which UrbFact operates, and you irrevocably submit to the exclusive jurisdiction of such courts in any such suit, action, or proceeding. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
19. Severability
If any provision of this Privacy Policy is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction for any reason, such provision shall be eliminated or limited to the minimum extent necessary such that the remaining provisions of this Privacy Policy will continue in full force and effect. The invalidity or unenforceability of any provision of this Policy shall not affect the validity or enforceability of any other provision.
20. Entire Agreement
This Privacy Policy, together with our Terms of Service and any other legal notices or agreements published by us on the Site, constitutes the entire agreement between you and UrbFact concerning your use of the Site and supersedes all prior or contemporaneous communications, proposals, representations, understandings, and agreements, whether oral or written, between you and UrbFact with respect to the Site and the subject matter hereof.

The date the Privacy Policy was last revised is identified at the top of this page. You are responsible for periodically visiting the Site and this Privacy Policy to check for any changes. Your continued use of the Site following the posting of any revised Privacy Policy constitutes your acceptance of and agreement to the changes.
